These Terms of Use constitute a legally binding agreement between you (“you” or “your”) and Bloxwap (“Bloxwap,” “we,” “our” or “us”). These Terms govern your use of the Bloxwap Services made available to you on or through the Bloxwap Platform or otherwise. Bloxwap Services may be provided by Bloxwap or any Bloxwap Affiliate.

By accessing the Bloxwap Platform and/or using the Bloxwap Services, you agree that you have read, understood and accepted these Terms, together with any additional documents. You acknowledge and agree that you will be bound by and will comply with these Terms, as updated and amended from time to time.

If you do not understand and accept these Terms in their entirety, you should not use the Bloxwap Platform.

RISK WARNING

The value of Digital Assets can fluctuate significantly and there is a material risk of economic loss when buying, selling, holding or investing in Digital Assets. You should therefore consider whether trading or holding Digital Assets is suitable for you in light of your circumstances.

Please ensure that you fully understand the risks involved before using the Bloxwap Platform and Bloxwap Services.

Bloxwap is not your broker, intermediary, agent or advisor and we have no fiduciary relationship or obligation to you in connection with any activities you undertake when using the Bloxwap Platform. No communication or information that we provide to you is intended to be, or should be construed as, advice of any kind.

You are responsible for determining whether any investment, strategy or transaction is appropriate for you and for any associated loss. We do not recommend that any Digital Asset should be bought, earned, sold or held by you. Before making decisions you should conduct due diligence and consult your financial advisor. We are not responsible for decisions you make to buy, earn, sell or hold Digital Assets based on information or services provided by us, including any losses arising from those decisions.

1 . Introduction

1.1 Bloxwap is a platform designed to assist with the creation and trading of Digital Assets. The Bloxwap group provides users with a platform to interact with such assets.
1.2 By using the Bloxwap Platform you are entering into a legally binding agreement with us. These Terms govern your use of the Bloxwap Platform.
1.3 You must read these Terms, together with documents referenced in them, carefully and let us know if you do not understand anything.
1.4 You acknowledge that you will be bound by, and agree to comply with, any relevant additional terms and conditions that apply to your use of the Bloxwap Platform.

2 . Eligibility

2.1 To be eligible to use the Bloxwap Platform, you must:
  a. be an individual or entity with full capacity to (i) access and use the Bloxwap Platform; and (ii) enter into and comply with these Terms;
  b. if acting for a legal entity, be duly authorised to bind such entity;
  c. not be located or established in, or resident of, or have business operations in:
    i. a jurisdiction where it would be illegal under Applicable Law for you to access or use the Bloxwap Platform; or
    ii. a country listed in our List of Prohibited Countries.

2.2 We may amend eligibility criteria at any time in our sole discretion. Where possible, we will give notice in advance but may need to make immediate changes if:
  a. required by legal or regulatory changes;
  b. changes are in your interest; or
  c. any other valid reason exists.
Where advance notice is not possible, we will inform you as soon as practicable.

3 . Bloxwap Platform

3.1 Usage is at our absolute discretion. We may refuse or restrict access at any time.
3.2 You must not post, upload or publish abusive, defamatory, dishonest or obscene content, market-manipulating messages, or content contravening Applicable Laws on the Bloxwap Platform. Doing so may result in termination or restriction.
3.3 You must not publish such content anywhere else in respect of Digital Assets created on the Bloxwap Platform.

4 . Fees and Calculations

4.1 Fees for use of the Bloxwap Platform can be found [here].
4.2 You agree to pay all applicable fees when requested.
4.3 You authorise us to deduct all applicable sums from the Wallet you connect.
4.4 Fees may be adjusted per Clause 14.4.
4.5 Calculations made by Bloxwap in connection with your use are final and binding in the absence of Manifest Error.

5 . Records

We keep your personal data to enable continued use of the Bloxwap Platform and as required by law, including for tax, accounting and AML purposes.

6 . Accessing the Bloxwap Platform

6.1 You must have suitable equipment and internet access. Use of bots or other methods may be subject to additional terms.
6.2 Access methods may be subject to additional terms communicated by us.

7 . Transactions

7.1 Where you execute any Transaction with Improper Intent or in case of Manifest Error, Bloxwap is authorised (without liability) to cancel or void such Transaction, take actions it deems fit, and treat it as though never entered into.
7.2 We may be required to share information about your activities with third parties and within the Bloxwap Group.

Livestream Moderation Policy

Purpose: To cultivate a social environment on Bloxwap that preserves creativity and freedom of expression while encouraging meaningful engagement free of illegal, harmful and negative interactions. This policy is a living document and may be updated in response to feedback.

Prohibited Content

Streams containing any of the following are prohibited and subject to immediate termination and suspension of future access to Bloxwap livestreams or to Bloxwap itself:

Violence: Graphic violence, threats, glorification of violent acts, or content promoting self-harm
Harassment: Targeted abuse, bullying or coordinated harassment campaigns
Sexual Content: Pornography, nudity without context, sexual exploitation or promotion of sexual violence
Under-Age Use: Livestreaming by anyone under 18
Youth Endangerment: Any CSAM or content promoting exploitation or grooming of minors (reported to law enforcement)
Illegal Activities: Content promoting illicit behaviour or violations of law
Privacy Violations: Sharing personal info without consent, doxxing, or broadcasting private individuals’ likenesses
Copyright Violations: Broadcasting protected content or IP without permission
Terrorism / Violent Extremism: Glorification or encouragement of violent acts

Appeals Process
